1. Purpose and scope

These General Terms and Conditions of Sale (GTC) apply to all orders placed on the websites konexauto.com, konexauto.fr and konexauto.eu with KONEXAUTO, a limited liability company (SARL) with a share capital of €1,000, registered in the Évry Trade and Companies Register under number 935 278 416, with its registered office at 1 Impasse de la Juine, 91000 Évry-Courcouronnes.

They govern the sale of new and second-hand car parts to private individuals (‘Consumer Customers’) and to businesses (‘Business Customers’). Placing an order constitutes acceptance of the GTC in force on the date of the order.

2. Products and compatibility

Products are described with the utmost care: part number, condition (new or used), photographs and compatibility details are provided. Photographs of used parts show either the part being sold or an equivalent part.

The part numbers, technical specifications and vehicle compatibility information displayed on the website are largely sourced from the TecDoc (TecAlliance) catalogue, the automotive parts sector’s leading reference database. This information is provided by the manufacturers and is for guidance only: KONEXAUTO cannot guarantee that this data is free from errors or omissions.

The Customer must check the part’s compatibility with their vehicle before placing an order, in particular using the original part number or the VIN. In case of doubt, they may contact KONEXAUTO, who will help them identify the correct part.

3. Prices

Prices are quoted in euros, inclusive of all taxes (VAT included), excluding delivery charges. Delivery charges are displayed before the order is confirmed.

KONEXAUTO may change its prices at any time. The price charged is the price displayed at the time the order is confirmed.

Certain parts, notably fuel injectors, are subject to a deposit. The amount of the deposit is stated on the product details page and is charged in addition to the price of the part. The deposit will be refunded upon return of the old part – of the same type and with the same reference number, complete and undismantled – within 30 days of delivery. The cost of returning the used part is payable by the Customer.

4. Ordering

The Customer selects their products, checks their basket, enters their contact details, chooses their delivery and payment methods, and then confirms their order. A confirmation email summarises the order.

KONEXAUTO may refuse or cancel an order in the event of a previous dispute, suspected fraud or product unavailability. In the event of unavailability after payment, the Customer will be notified and refunded within 14 days at the latest.

5. Payment

Payment is made online by credit card (via Stripe), PayPal or Klarna. The order is processed once payment has been confirmed.

With Klarna, the Customer may, depending on the options offered at the time of payment, pay in instalments or defer payment. This service is provided by Klarna Bank AB (publ), which has sole discretion to accept the application following verification. Klarna’s terms and conditions apply and are presented to the Customer before confirmation.

Bank details are processed directly by these secure payment providers: KONEXAUTO never has access to them and does not store them.

6. Delivery

Products are delivered to the address provided by the Customer, within the following areas: mainland France, Corsica, overseas departments and territories, and European countries. For shipments to overseas territories and outside the European Union, any customs duties, taxes or port charges may be payable by the recipient upon delivery.

Carriers: Colissimo, Chronopost, DPD or GLS, depending on the parcel and destination. Dispatch time: 24 to 48 working hours after payment confirmation. Charges: calculated based on the parcel’s weight and destination, and displayed before the order is confirmed.

If no delivery timeframe is specified, delivery will take place no later than 30 days after the order is placed. In the event of a delay, the consumer customer may rescind the contract in accordance with Articles L216-6 et seq. of the French Consumer Code.

The Customer must check the condition of the parcel on receipt and raise any objections with the carrier, then inform KONEXAUTO within 3 days. For consumer Customers, the risk passes upon taking possession of the parcel.

7. Right of withdrawal (Consumer Customers)

Consumer Customers have 14 days from receipt of their order to withdraw from the contract, without having to provide a reason. They must notify KONEXAUTO by email ([email protected]) or using the form below.

The product must be returned within 14 days of the withdrawal, complete and in its original packaging where possible. The Customer is responsible for the return postage costs.

KONEXAUTO will refund the full amount paid, including the initial delivery charges (based on the standard delivery method), within 14 days of the cancellation. The refund may be deferred until the product is received or proof of its dispatch is provided.

The Customer may be held liable in the event of any depreciation in the product’s value resulting from handling other than that necessary to establish its nature and proper functioning. A part fitted to a vehicle, or one that is damaged or soiled, may therefore be subject to a deduction from the refund.

8. Statutory guarantees (Consumer customers)

All products, whether new or second-hand, are covered by the statutory guarantee of conformity (Articles L217-3 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code).

Statutory guarantee of conformity. The consumer has two years from the date of delivery of the goods to invoke the guarantee. They may choose to have the goods repaired or replaced. Failing that, they may obtain a price reduction or rescind the sale. They do not have to prove the existence of the defect if it becomes apparent within 24 months of delivery for a new item, and within 12 months for a second-hand item.

Warranty against hidden defects. The buyer may take action within two years of discovering the defect. They may choose between cancellation of the sale and a price reduction.

These guarantees do not cover damage resulting from assembly that does not comply with the manufacturer’s instructions, misuse or normal wear and tear. For any claims, the Customer should contact KONEXAUTO by email or at the shop.

9. Business customers

The provisions of Articles 7 and 8 relating to consumers (right of withdrawal, statutory guarantee of conformity) do not apply to business customers. Parts are guaranteed against hidden defects for business customers.

Invoices are payable in full upon ordering. Any delay in payment shall result in penalties at the interest rate applied by the ECB plus 10 basis points, as well as a fixed compensation of €40 for recovery costs (Article L441-10 of the Commercial Code).

For business customers, risk passes to the customer upon handover of the goods to the carrier.

10. Retention of title

The products remain the property of KONEXAUTO until the price has been paid in full.

11. Personal data

Data collected when placing orders is processed in accordance with the Privacy Policy.

12. Governing law and jurisdiction

These Terms and Conditions are governed by French law. For consumer customers, the competent court is determined in accordance with the relevant legal provisions. For business customers, any dispute shall be referred to the Commercial Court of Évry.
